Manitoba Public Insurance Online Services - Terms of Use

Your access to and continued use of The Manitoba Public Insurance Corporation’s ("Manitoba Public Insurance") online services, as amended or updated, (the "Service") constitutes your acceptance and compliance with the following Terms of Use. If you do not agree to these Terms of Use, you should immediately discontinue any use of the Service. You also accept that these Terms of Use may change from time to time and that these changes will be binding upon you. You agree that it is your responsibility to check for any changes to these Terms of Use. The most recent revision date for these Terms of Use is shown above.

Purpose

The Service provides a channel for customers to conduct business with Manitoba Public Insurance, along with other relevant information related to Manitoba Public Insurance, and the interactions you have with Manitoba Public Insurance, or the services Manitoba Public Insurance provides to you.

The Service is not intended to provide legal advice, and is not to be relied upon as binding in any dispute, claim, action, demand, or proceeding of any kind involving Manitoba Public Insurance. The Manitoba Public Insurance Corporation Act, The Highway Traffic Act, and The Drivers and Vehicles Act, together with their accompanying regulations, along with any other applicable legislation should be consulted for the interpretation and application of the law. If there is any omission from the Service, or any contradiction or difference between the Service and any statute or regulation, you must treat the statute or regulation as the full and correct statement of your rights and obligations at law.

Reserved Rights and Grant of Limited Licence

Copyright to the Service is owned by Manitoba Public Insurance. All rights are reserved. Manitoba Public Insurance either owns the intellectual property rights, including copyright, or has acquired the necessary licences and permission in the information on the Service, including all text, HTML code, multimedia clips, images, graphics, icons, and Java code, and the selection and arrangement of the contents of the Service (collectively called the "Information"). As a user of this Service, you are granted a limited licence to display or print short extracts of the Information for your own personal use, provided the Information is not changed in any way. You will be fully responsible for any consequences resulting from your use of the Service, and you must keep intact all copyright, trademark, and other proprietary notices. Any other use of the Information is prohibited. None of the Information may be otherwise reproduced, republished, re-disseminated, modified, adapted, altered, or changed in whole or in part, in any manner or form without the prior express written consent of Manitoba Public Insurance. Manitoba Public Insurance reserves the right to require that you delete, destroy, or otherwise remove any Information that is used in a manner that, in the opinion of Manitoba Public Insurance, is contrary to these Terms of Use, any other agreements between you and Manitoba Public Insurance, or is otherwise inappropriate, derogatory, offensive, or illegal. Manitoba Public Insurance will take appropriate legal action to enforce its rights.

Trademarks

Certain words, phrases, names, designs or logos used on the Service may constitute trademarks, service marks, or trade names of Manitoba Public Insurance or other entities. The display of these marks or names on the Service does not imply that a licence has been granted by Manitoba Public Insurance or by those other entities to you. You are not permitted to use or change these trademarks, service marks, or trade names without the prior written consent of Manitoba Public Insurance, or the other applicable entities, as the case may be.

Code of Conduct

You must not attempt to access any Information for which you do not have authorization or explicit consent to access. You agree not to impersonate another person, organization, or account in the use of the Service, or in the sending of electronic messages listed on or through the Service. You shall not, and shall not attempt to create and/or distribute malicious programs (e.g., viruses, worms, Trojan horses, email bombs, etc.) in the Service. You agree that you shall use the Service in accordance with the Terms of Use and all applicable laws.

Monitoring

Your use of the Service may be monitored at any time, with or without notice, by Manitoba Public Insurance. Manitoba Public Insurance reserves the right to log and monitor network traffic for security events, which may include accessing any data traversing the Service.

Access Restriction

Manitoba Public Insurance may block or restrict you or your account’s access. Manitoba Public Insurance has the right to approve, monitor, restrict, and/or block any access to the Service at any time for any reason.

No Endorsement

The Service may contain links to other non-MPI websites or third party applications placed there for your convenience. These links or applications are provided as references to help you identify and locate other resources or services that may be of interest that are independently developed by parties other than Manitoba Public Insurance. Manitoba Public Insurance does not control the content of, or maintain any type of editorial control over, those websites or applications. Manitoba Public Insurance does not assume any responsibility for the accuracy or appropriateness of the information or materials contained, created, or published at these websites or within the applications. In providing links to other websites or applications, Manitoba Public Insurance is not acting as a publisher or disseminator of the material contained on those other websites or applications. Privacy Statement

The confidentiality of your personal information and personal health information is important to Manitoba Public Insurance. Manitoba Public Insurance is governed by, and adheres to, the provisions of The Freedom of Information and Protection of Privacy Act (Manitoba) and The Personal Health Information Act (Manitoba). Any personal information or personal health information received by Manitoba Public Insurance as a result of your access to this Service or your submission on the Service will be kept confidential to the extent permitted by law.

Manitoba Public Insurance collects statistical data by using Google Analytics or other tools to gather information about usage of this Service. The information collected is aggregate data only and does not identify specific individuals. The information is collected for the following purposes:

  • To help us make the Service more useful to visitors

Manitoba Public Insurance reminds you that it is disclosing this Information pursuant to the provisions of The Freedom of Information and Protection of Privacy Act (Manitoba) and The Personal Health Information Act (Manitoba).

MPI may send you receipts and/or confirmations of your Service activities via the email address(es) you provide to the Service.

Manitoba Public Insurance may use contracted third party providers to handle the confidential, personal, and personal health information you have provided in the Service in accordance with the provisions of The Freedom of Information and Protection of Privacy Act (Manitoba) and The Personal Health Information Act (Manitoba).

Submissions

All information submitted to Manitoba Public Insurance via the Service, including but not limited to email communications, feedback data, questions, comments, suggestions, corrections and bug reports, and any other communications of any sort (collectively, "Feedback"), shall be deemed to be, and shall remain, the property of Manitoba Public Insurance. Subject to the above Privacy Statement, Manitoba Public Insurance will be free to use any ideas, concepts, know-how, or other techniques contained in the Feedback, and will be free to use, reproduce, disclose, exhibit, display, transform, adapt, create derivative works of, and distribute the Feedback to others for any purpose whatsoever.

No Advice or Warranties

Information provided on the Service is believed to be reliable at the time it is posted. Manitoba Public Insurance does not, however, guarantee the quality, accuracy, completeness, or timeliness of the information provided. Manitoba Public Insurance assumes no obligation to update the Information, or to advise on further developments concerning the topics mentioned. Information contained on the Service may contain typographical errors. Information provided may be changed without notice. Access to this Service is provided on an “as is” and “as available” basis. You should not assume that the Service will be error-free or that the Service will operate without interruption. Computer Viruses

No Liability

Manitoba Public Insurance is not and will not be responsible for any direct, indirect, special, incidental or consequential damages, or any losses, damages, costs, causes of action, claims, liabilities or demands of any kind with respect to any injury to persons (including, without limitation, death), damage to or loss of property, economic loss or infringement of rights (including, without limitation, privacy rights) caused by, or arising directly or indirectly from the use of the Service, or in reliance on the information available on the Service. Manitoba Public Insurance disclaims any liability for unauthorized use or reproduction of any portion of the Service.

Indemnity

You agree to defend, indemnify, and hold Manitoba Public Insurance harmless from all losses, damages, costs, causes of action, claims, liabilities, or demands of any kind with respect to any injury to persons (including, without limitation, death), damage to or loss of property, economic loss, or incidental, or consequential damages, or infringement of rights (including, without limitation, privacy rights) caused by, or arising directly or indirectly from your use of the Service or the violation of these Terms of Use.

Choice of Law

The laws of the Province of Manitoba and the laws of Canada will govern the interpretation, validity and effect of these Terms of Use, notwithstanding any conflict of laws provision of your domicile, residence, or current physical location. You consent to, and submit and attorn to, the jurisdiction of the courts of the Province of Manitoba in any action or proceeding instituted under, or related to, these Terms of Use.

Invalidity

If, for any reason, one or more terms and conditions of these Terms of Use are found by a court to be void, voidable, or otherwise unenforceable, that finding will not affect the validity of the remaining provisions.

Waiver

The failure of Manitoba Public Insurance to insist upon or to enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of that, or any other, provision or right. To be binding upon Manitoba Public Insurance, any waiver must be in writing and must be signed by one or more of its duly authorized representatives. The waiver by Manitoba Public Insurance of a breach of any provision of these Terms of Use shall not operate as, or be construed as, a waiver of any subsequent breach thereof.

Additional Terms

These Terms of Use are in addition to and other applicable legal terms or agreements you have with Manitoba Public Insurance. If you are performing any financial transactions on the Service the additional Online Payment User Terms and Conditions shall apply to such financial transactions.
